Can a pharmacy refill a prescription even if there are no refills left?

The prescription is for birth control. I moved from my home town and in the new city that I'm in, there are no doctors that take my insurance. The pharmacy has tried contacting my old doctor to get the refill authorization but they haven't answered. Can the pharmacy refill it just once until we figure out what's going on?

  1. No, with some drugs the pharmacist can use his/her discretion to give you maybe 2 or 3 days worth with certain drugs, but they cannot legally give someone refills on an expired prescription.
  2. no, you have to get more refills from your doctor
  3. Legally, the answer is no. In reality, this is occasionally done at the pharmacist's discretion. You however, would not meet the minimum requirements for this special service in my opinion because you are new to the pharmacy.
